"FAST FOX LLC" SRL, with its headquarters in the Republic of Moldova, mun. Chișinău, str. Mihail Kogălniceanu 49, ap. 10, fiscal code: 1024600006650 ("FAST FOX"), promotes the use of non-polluting means of transportation through the use of electric scooters. As a user of the scooters, you will be able to benefit from our services under the following terms and conditions ("Terms and Conditions").
The Terms and Conditions establish the manner of use of the services offered by FAST FOX. By accessing and/or using FAST FOX services, YOU AGREE TO THE PROVISIONS OF THIS DOCUMENT.
FAILURE TO ACCEPT THIS DOCUMENT WILL MAKE IT IMPOSSIBLE TO USE THE SERVICES provided by FAST FOX.
Please read this document carefully.
1. GENERAL TERMS
The FAST FOX Terms and Conditions apply to all users of the application and implicitly to the services offered by FAST FOX.
You can benefit from FAST FOX services by accepting the Terms and Conditions, thus this document will represent the contract between you and FAST FOX.
By using FAST FOX services, you agree to the conditions of this document.
FAST FOX does not take responsibility for any display errors in the application content, for incorrectly displayed or inaccessible graphic elements, nor for the proper functioning of external content sources referenced in the materials presented within the application.
This document may be revised periodically, with FAST FOX not being obliged to inform users of these modifications, except in the case of significant changes, in which case the information will be provided by displaying the information regarding the changes in the application (push notification) and on the official FAST FOX website.
Any significant modification will take effect within 10 (ten) calendar days from the date of publication of the information regarding the modifications, except for new users who will be subject to the Terms and Conditions from the date of creating the user account.
2. USER ACCOUNT
Access to the application is free. The FAST FOX application on mobile phones is available for both Android and iOS.
The user is solely responsible for the activity carried out within the FAST FOX application.
Steps to create a user account:
To be able to use the FAST FOX application and implicitly to benefit from the services offered through the application, it is necessary to create a user account (User Account).
To create a user account, you will register personal data in the corresponding fields: name, email address, phone number.
If the phone number is changed or lost, the account cannot be recovered, however, the money remaining in the lost account can be refunded or transferred to a new account. In this case, you should contact "Customer Service" via the email address used to register the lost account, with the request to refund or transfer the remaining funds.
For account registration, it is necessary to enter correct and complete data and, if necessary, to update the registered data.
FAST FOX reserves the right, at any time and without prior notice, to refuse registration or to delete or limit an account (temporarily or permanently), if it contains incorrect or false data, as well as in other justified cases.
The user account is personal and cannot be transferred to third parties.
FAST FOX service beneficiaries can only be users who are at least 16 years old.
The use of FAST FOX electric scooters by a person who has not reached the age of 16 is prohibited. If the activation of a scooter using the account/data of a minor is allowed, the account holder will be fully responsible for any damages, physical injuries, or any other consequences resulting from unauthorized use.
The history of all trips made since the account was created will be available within the application.
3. ACCOUNT VALIDATION
After uploading your bank card data into the application, your user account is validated. The card data is requested solely for the purpose of paying for trips through the application, and is not stored on FAST FOX servers, but on the resources of the payment system used.
Once you have entered the card details, the system will deduct a payment of 50 Lei for verifying the bank card and payment capacity, and that amount will automatically be included in "my account" in the application, which you can use to pay for our services. If you no longer wish to benefit from our services, you can request a refund by sending an email or contacting "Customer Service".
If, for any reason, there are doubts about your identity/card, FAST FOX may request presentation of an identity document to validate your identity/cardholder.
4. PAYMENT FOR SERVICES
After validating your user account, you will be able to benefit from FAST FOX services by picking up a FAST FOX electric scooter from the locations indicated in the application according to the rates set in the application and on the official FAST FOX website.
To use the FAST FOX application, a minimum amount of 100 lei will be transferred as an advance to your FAST FOX account, hereinafter referred to as "account", which will be subsequently used to pay for the trips made. For loading the account, you have the options of 100 lei, 200 lei, and 500 lei, or the amount you desire, but not less than 10 lei. If the available amount in the account does not cover the cost of a trip, FAST FOX reserves the right to automatically withdraw the difference from the bank card inserted in the application. The payment obligation for the service provided under the distance contract to the transport service provider will be considered fulfilled when the funds are transferred from your account to the company's bank account "FAST FOX LLC" S.R.L.
To validate the account, you need to complete your card details (credit/debit), including the card number and expiration date. By entering this information, you guarantee that these details are valid and that you are authorized to use the card.
Payments are processed through the payment processor - MAIB (alternatively Stripe.com). When making payments through the application, FAST FOX is not responsible for any payment costs incurred by third parties (for example: mobile phone operators, bank fees). As a user, you understand and accept that certain service providers may charge additional fees for processing payments. FAST FOX is not responsible for any additional costs in relation to the fare for the trip made by the user, and assumes no responsibility in this regard.
By entering the card details, you understand and accept that at the time of picking up a scooter, FAST FOX will deduct the amount corresponding to the trip from "my account" available in the application or, if necessary, from the card registered in the application. Through the Terms and Conditions document, you agree to this and understand that FAST FOX will automatically withdraw the amount for each trip made through the mobile application upon completion of the trip.
If you notice any discrepancies in payment, you must contact our company within a maximum of 30 (thirty) working days from the payment date and provide all the necessary information to identify the payment subject to analysis, including the date, start/end time, and any other details necessary to resolve the issue.
The maximum rental period for a FAST FOX scooter is 24 hours, within the remaining battery percentage. After this period, you have the option to start a new trip, subject to the same conditions.
Electric scooters not returned within 24 hours of rental will be considered lost or stolen, and the last user who did not return the scooter will be charged a penalty of 3000 lei. The amount will be deducted from the card account used for registration, like any usual payment for renting FAST FOX scooters, without the right to return the funds to the user. In the event that the scooter is confirmed lost or stolen, the user will voluntarily return the equivalent of the cost of a scooter, amounting to 20,000 lei. In the absence of voluntary reimbursement by the user, FAST FOX may take all legal measures recognized by law to recover the amount.
The application will indicate the starting location of the trip, the final destination, and the cost of the service provided by FAST FOX at the user's request. FAST FOX will send an invoice extract upon users' request via electronic correspondence.
5. PICKUP AND PARKING OF ELECTRIC SCOOTERS
Identifying a scooter can be done using the FAST FOX mobile application with the help of the map on the main page. Users will check the electric scooter panel to ensure it is not discharged. Users understand and assume that if the electric scooter is not fully charged, its battery may deplete during the trip, and FAST FOX is not responsible for the consequences, and this cannot be the basis for claiming damages. When picking up an electric scooter, users confirm that they are in a physical and mental condition suitable for riding, not under the influence of alcohol, drugs, psychotropic substances, or any other substances that may impair their ability to use the FAST FOX scooter. At the end of the trip, users are obligated to return the electric scooter in the same condition as it was received and to park it in permitted areas on public property without obstructing pedestrians or vehicles. The electric scooter will be parked vertically using the kickstand.
In the event of improper parking of the electric scooter resulting in a fine to FAST FOX, FAST FOX will recover the amounts paid in this regard from the user. Also, users agree that our company will pay directly, on their behalf, any fines incurred due to improper use of the electric scooter, and they will reimburse the respective amount as well as any additional expenses into the "FAST FOX LLC" S.R.L. account within 15 days from the date of providing proof of payment.
By accepting this document, users agree to bear any fines, fees, damages, and legal expenses or any other costs caused by improper parking of the electric scooter or violation of any laws/regulations while using the services provided by FAST FOX.
To avoid any prejudice, users are prohibited from:
1. Violating any laws, rules, or regulations, including riding electric scooters on sidewalks and/or parking them outside designated areas. Also, riding on road sections where the speed limit is higher than 50 km/h is prohibited. The use of scooters by persons under the age of 16 is also prohibited.
2. Carrying any briefcase, backpack, or bulky bag that may hinder the ability to operate the electric scooter.
3. Using a mobile phone or any device capable of transmitting text messages or similar messages while riding, using audio headphones.
4. Moving the electric scooter on private property or any other space that may restrict access to it. In this situation, users will be required to pay all necessary expenses for its recovery.
5. Transporting the electric scooter using other vehicles (e.g., bus, car, etc.).
If any malfunction is noticed in the electric scooter picked up, users are obligated to immediately notify "FAST FOX LLC" S.R.L through the application's "Customer Service" section. Failure to comply with this obligation will be attributed to the user, who will be responsible for any subsequent consequences.
If the delay in return or non-return of any electric scooter was caused by reasons beyond the user's control (e.g., scooter malfunction, unfavorable weather conditions, etc.), there is the possibility of requesting FAST FOX to pick up the electric scooter by contacting FAST FOX at the phone number +373 76547777 beforehand. In the absence of an express request made in this way, the user will bear the consequences resulting from the delay in return or non-return of any electric scooter.
6. DAMAGE CAUSED TO SCOOTERS
Electric scooter users are solely responsible for their integrity. Any damage caused by the user at the time of scooter return will be borne by the user. The repair cost will be communicated to the user within 5 working days by FAST FOX.
In case of any malfunctions, the user is obligated to immediately notify "FAST FOX LLC" S.R.L by phone at +373 76547777 or by email at the general contact address: office@foxscooters.md or through the mobile application using the "Customer Service" section.
If the malfunction was due to the user, the user must notify FAST FOX within one hour.
7. USER OBLIGATIONS
The user is obligated to use the electric scooter with the care of a prudent owner only for the purpose for which it was provided by FAST FOX, respecting the normal conditions of use and operation, without other passengers.
The user understands that the services are provided in a personal capacity, and if they allow others to use the electric scooters through their personal account, they will be solely responsible for any damages caused by the respective user, under the conditions stipulated in this document.
The user is obligated to comply with the applicable regulations/laws regarding traffic on public roads and to use electric scooters safely.
The use of electric scooters under the influence of alcohol and other prohibited substances is strictly prohibited.
The user is obligated to park the electric scooters in permitted locations without blocking traffic, as well as to use the electric scooters only in the areas permitted on the application map.
The user is obligated not to transport the electric scooter using other means of transportation, regardless of their nature.
The user is obligated to bear any damages caused by exceeding a weight of 100 kg, with the risk of accidents.
The user is obligated to report any defects observed in the electric scooters to FAST FOX.
At the end of the permitted rental period, the user is obligated to return the electric scooter in the condition it was received. The scooter will be parked in public spaces without obstructing access and traffic.
If the user fails to return any electric scooter picked up on time and in good condition, the user will incur additional costs, including late penalties of 300 lei/hour and repair/replacement costs for parts, as well as any other additional costs.
8. FAST FOX LIABILITY
As an individual service operator, FAST FOX cannot guarantee or assume responsibility for the quality or presence of defects in the provision of transport services.
FAST FOX and its employees are not responsible for any loss or damage that the user may suffer as a result of using the electric scooters contracted through the FAST FOX application, including, without limitation, any material damage or monetary losses.
FAST FOX is not responsible for the improper use of electric scooters by the user in a manner that contravenes their safety or that of others.
FAST FOX will not be responsible for the user's actions or inactions related to the operation of electric scooters and will not be liable for any damages caused by the user during or after the trips.
If the services have already been fully provided by FAST FOX, or if the execution has begun with the express consent of the user and after the user has confirmed that they will lose their right of withdrawal after the complete execution of the contract by FAST FOX, it is considered that FAST FOX has fully provided the service to the user immediately after the start of the trip.
FAST FOX will not be liable for any errors or irregularities encountered in the application, but will make every effort to remedy any errors related to the operation of its services.
By accepting this document, the user understands and acknowledges that the use of electric scooters is solely at their own risk and liability, and that FAST FOX is not responsible for the consequences, actions/inactions, legal expenses, repair costs for any known or unknown damages.
Through this document, the user expressly agrees and acknowledges that they fully understand the risks associated with using the equipment provided by FAST FOX and expressly assume this risk.
Additionally, the user understands that electric scooters are vehicles that can malfunction, even if properly maintained, and that such a malfunction can cause harm.
The user agrees and understands that using electric scooters involves certain risks, obvious and less obvious dangers, which may lead to injury or even death to themselves or others.
9. TERMINATION OF THE REMOTE CONTRACT WITH FAST FOX.
The contract concluded between FAST FOX and the user can be unilaterally terminated by closing/blocking the user's account due to serious breaches of this document.
Additionally, the contract may be terminated by deleting the user's account at the user's initiative.
Termination of the contract in any manner will not modify or affect the user's obligations due at the date of termination.
10. INTELLECTUAL PROPERTY RIGHTS
The name of the application and its graphic symbols are registered trademarks owned by "FAST FOX LLC" S.R.L., and may not be reproduced, copied, or used without the written consent of the owner/holder.
The entire content presented or displayed within the application, including, but not limited to, text, graphics, images, moving images, sound, and illustrations, photographs, is the property of FAST FOX.
All elements of the electric scooters, including, but not limited to, the overall design and the content of the application, are protected by copyright, author rights, and other laws regarding intellectual property rights.
FAST FOX services may only be used for the purpose expressly provided for in this document.
The user may not modify any materials and may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or works contained in the application.
Except for actions permitted by applicable copyright law, the user is responsible for obtaining permission before reusing any copyrighted material made available by FAST FOX.
11. THIRD-PARTY LINKS
The FAST FOX application may provide third-party links to other websites/applications over which our company has no control. FAST FOX is not responsible for any damage thus created and assumes no responsibility for the content of these links or the quality of services offered by these third-party websites/applications.
12. PROCESSING OF PERSONAL DATA
The processing of FAST FOX user's personal data is carried out in accordance with the legislation of the Republic of Moldova (Law no. 133/2011 on the protection of personal data).
For the purposes of this contract, the data subject to processing may include: name, email address, address, contact details, phone number, bank card details, trip history, current location, and remaining credit in "my account."
Processing cannot be extended to other purposes unless the parties expressly agree or there is a legal obligation giving any party the right to process the data.
Upon termination of this contract, FAST FOX undertakes to cease the processing of data, except where there is a legal obligation to continue processing the data or exercise rights in court and/or before public authorities with control attributions.
13. JUSTIFICATION DUE TO AN IMPEDIMENT AND DISPUTES
The non-performance of obligations arising from this Contract is justified if it is due to an impediment beyond control and if the party invoking the impediment could not reasonably be expected to avoid or overcome the impediment or its consequences.
The party invoking the above-mentioned event is obliged to immediately and fully inform the other party of its occurrence and to take any measures available to limit the consequences of that event.
The party invoking the above-mentioned event is exempted from this obligation only if the event prevents it from carrying it out.
This Contract is subject to the legislation of the Republic of Moldova.
14. APPLICABLE LAW
By using/visiting/viewing/etc. the application and/or using any service provided by FAST FOX, the user agrees to the provisions of the Terms and Conditions.
Any dispute regarding this document that may arise between the user and FAST FOX will be resolved amicably, and in case of failure, any disputes/differences between the parties will be settled by the competent authority/court of the Republic of Moldova.
This document has been drafted and will be interpreted in accordance with the legislation of the Republic of Moldova.
